  1. Open your business account or eForms. Go to the filing options on the Virginia Tax sales tax page and choose to file with your business account or with eForms.
  2. Select the ST-1 return. Choose the reporting period you are filing for.
  3. Enter your sales. Report gross sales, deductions such as exempt sales, and the tax due for the period.
  4. Review the return. Check the totals against your records before you submit.
  5. Submit and pay. Pay online or schedule the payment for the due date.
  6. Save your confirmation. Keep it with your records for the period.

Virginia's rate is not the same everywhere, so check the rate that applies to each sale rather than reusing one figure for the whole state. Due dates and the weekend rule

Monthly returns are due on the 20th of the month following the reporting period. Quarterly returns are due on the 20th of the month after each calendar quarter ends. Filing a zero return

You must file even when you had no sales. The regulation states that every dealer must file a return by the 20th day of the month following each reporting period even if no tax is due, and Virginia Tax repeats that you must file every month or quarter, depending on your frequency, even if no tax is owed. File the ST-1 online and report zero for the period. Virginia Tax's late penalty applies even when no tax is owed, so missing a zero return still costs money.

Amending a return

Payment methods

Sales tax must be filed and paid electronically. Virginia Tax lists these options for business taxes:

  • Online account: Pay through your Virginia Tax business online services account, which supports sales tax.
  • eForms: Free electronic filing and payment with no login required.
  • ACH credit: You send the payment from your bank account to Virginia Tax. Your bank may charge a fee, and the Electronic Payment Guide has setup details.
  • Scheduled payments: You can schedule a payment up to the due date.
  • Check or money order: Payable to the Virginia Department of Taxation, with your tax account number and period.

If you cannot file and pay electronically, you must submit an electronic filing waiver request. A payment your bank does not honor can carry a $35 fee, on top of any other penalties or interest.

The dealer discount

Virginia allows a dealer discount as compensation for collecting and remitting the tax. Under the Code of Virginia, the discount applies only if the amount due was not delinquent at the time of payment, so paying late can cost you the discount. Check the current schedule on the Virginia Tax site or in the statute before you take it.

Penalties and interest for late filing

  • Late filing penalty: If you file more than 6 months after the due date and owe tax, the penalty is 6% per month, up to a maximum of 30% of the tax due.
  • Late payment penalty: If you file within 6 months of the due date but pay after that period, a late payment penalty of 6% per month applies, also capped at 30%.
  • Minimum penalty: $10, even when no tax is owed.
  • Interest: The federal underpayment rate under Internal Revenue Code Section 6621, plus 2%, on unpaid tax.
  • Penalty waivers: For penalties of $2,000 or less, you can write to Virginia Tax with documentation of extenuating circumstances. Larger penalties require an offer in compromise.

Common mistakes to avoid

  • Skipping zero returns. A return is due every period, even with no sales, and the minimum penalty is $10.
  • Filing on the wrong schedule. Use the monthly or quarterly frequency in your latest notice from Virginia Tax.
  • Missing the quarterly date. Quarterly returns are due on the 20th of the month after the quarter ends, not the end of the quarter.
  • Waiting for a paper form. Sales tax must be filed electronically unless you have an approved waiver.
  • Ignoring nexus. Remote sellers can owe Virginia tax after crossing $100,000 in annual gross sales or 200 transactions, without any physical presence.
