How to fill out and accept the certificate
- Get a copy of the buyer's Oklahoma sales tax permit. If it is unavailable, record the buyer's name, address, permit number, and permit expiration date.
- If you have no permit copy and the details have not been verified before, verify them with OTC Taxpayer Assistance or the OTC permit-holder list (OkTAP lookup or Form 13-98 file).
- Get a signed statement (on the invoice or a separate document) that the items are bought for resale and that the buyer is in the business of reselling them.
- File the documentation with the invoice within 90 days of the sale and refresh it when the permit expires.
When a seller is protected
The vendor is relieved only if all three conditions are met (OAC 710:65-7-6): good faith, which means strict compliance with statutory requirements; timely acceptance, with documentation in hand within 90 days after the sale; and properly completed documentation as defined in OAC 710:65-7-8. Relief does not apply to fraud or to soliciting improper claims.
Seller record-keeping
Keep the exemption documentation with the sales invoice for 3 years from the invoice date or the date the sales tax was remitted, whichever is later (OTC Publication D).
